Call of Duty – Black Ops 2: Could a Lawsuit Follow?
Could there be trouble ahead for Call of Duty – Black Ops 2 developers Treyarch? GameInformer have uncovered some documents that show that publishers Activision had in fact signed a contract with the developers of the Call of Duty – Modern Warfare games giving them full rights to the use of the Call of Duty brand in all settings post Vietnam.
Call of Duty – Black Ops 2 is set in the near future, so does that mean that Treyarch are going to have to pay Infinity Ward for damages? Hopefully not. If anybody should have to pay it is Activision. They have such tight control over the Call of Duty brand that when Treyarch came to the with the plan for Call of Duty – Black Ops 2 someone at Activision should have popped up and said, “hang on, didn’t we sign that contract with Infinity Ward?”. A reasonable person can see that Treyarch and Infinity Ward are not trying to be in direct competition with each other, it is true that both developers make Call of Duty games, but they both have completely different styles. It is just Activision’s fault for limiting their brand.
Game Informer also believes that Activision could be the ones who find themselves at the sharp end of a lawsuit. The damages could be in the millions. However if there is a publisher that can surely take that level of financial penalization it is Activision. For what it is worth, Treyarch’s vision of the not too distant future looks surprisingly good. Check out the reveal trailer above!
